Dear Governor Lamont,
Proponents say HB5002 is “opt ins”, when the most egregious provisions are mandatory:
– Towns and cities can no longer require apartment buildings under 24 units to provide parking for tenants
– Every commercially zoned lot can be developed up to 9 townhouses – impacting all retail stores on CT’s main streets, destroying downtowns
– Mandates creating ‘realistic opportunity’ that Fair Share quota are built – forces dense rezoning of mostly market value units without regard to capacity, budget, property taxes, traffic, or open space
– Deprioritized state funding if municipalities do not opt-in to state zoning czar in transit areas and allow onerous as of right mandates on up to 9 units residential, 8-30gs and affordable developments in transit areas
– Towns forced to pay for a developer’s legal fees should they lose an 8-30g appeal at a judge’s discretion
– Eliminates residents’ right to protest zoning changes by requiring 50% for protest petitions from and lowering the P&Z approval from a 2/3 majority to simple majority
– As-of-right sections of bill prevents public hearings where residents cannot raise environmental issues and file environmental, safety, flooding and other concerns
